1. GENERAL

The general terms and conditions of business are drawn up in accordance with regulations in the field of consumer protection, based on the recommendations of the Chamber of Commerce of Slovenia and international codes for online and electronic business. The online store www.alfies-corner.com - a way of life (hereinafter referred to as the "online store") is managed by ALFIE'S CORNER, TANJA SIČANOVIĆ S.P., CIGLENCE 58A, 2241 SP. DUPLEK, a provider of electronic business services (hereinafter referred to as the "Merchant").

By making a purchase, the consumer allows the Trader to store, process and use personal data provided during orders or on the online form, until cancellation, for the purpose of offering goods, surveys and statistical data processing. The individual can at any time request in writing or in another way that the Trader permanently or temporarily stops using his personal data.

These General Terms and Conditions define the operation of the online store, the rights and duties of the visitor (user) and the buyer, and the business relationship between the Merchant and the user as a buyer of products from the online store. The content on the website is for informational and educational use and is not intended as a substitute for medical consultation. We advise the buyer to consult their personal physician regarding the usefulness of the advice and suggestions.

2. AVAILABILITY OF INFORMATION

The merchant undertakes that the following will always be available to the user:
information about the Merchant's identity (company name and registered office and company register number);
contact information that enables the user to communicate with the Merchant (email address and telephone);
information about the characteristics of the products offered by the online store, including after-sales services and guarantees;
information about the availability of products from the online store offer;
method and terms of product delivery (location and delivery date);
information about the payment method;
information on the options and method of returning products;
information on the user complaint procedure and details of the Merchant for contacting users.

3. PRODUCT OFFER, DELIVERY TIME AND ACCEPTANCE

The range of products in the online store may change.

3.1. Promotions and discounts
The website may offer discounts for certain products that are valid for a limited time.

3.2. Delivery time
The delivery time for products in stock is, as a rule, 1 to 5 working days for delivery addresses in Slovenia, unless Pošta Slovenije delivers to an individual delivery address later (see point 10).

3.3. Collection of products
When submitting a purchase order, the user can specify one of the following methods of picking up the products:
After collection - in this case of purchase, the buyer pays the postage costs upon collection of the ordered goods. These costs depend on the size of the purchase amount and the weight of the item.
According to the pre-invoice - in this case of purchase, the buyer pays the postal costs before sending the ordered goods. These charges depend on the weight of the item.

4. METHODS OF PAYMENT

The merchant allows the user the following payment methods for purchasing products via the online store:
Cash on delivery via Pošta Slovenija.
Payment by pre-invoice to the buyer's desired payment method.
Paypal Payment.

5. PRICES

All prices in the online store are stated in euros and exclude VAT, unless explicitly stated otherwise. All prices in the online store are product prices and do not include delivery costs. All prices apply to electronic orders of products via the online store, orders over the phone or via e-mail.

All prices are valid at the time of placing the order and do not have a predetermined validity, so they are valid only until they are changed each time.

6. PURCHASE PROCEDURE

6.1. Order accepted
After placing the order, the buyer receives a proforma invoice and notification that the order has been accepted by e-mail from the Merchant. The sales contract for the purchase of the ordered products between the user (buyer) and the Merchant is irrevocably concluded at this stage (see point 7.).
If the Merchant has not yet shipped the order, the buyer can change the content of the order by calling 01 620 7595.

6.2. Lack of goods
After receiving the order, the merchant checks the availability of the ordered products. In the event of a shortage of goods, the trader contacts the buyer electronically or by telephone and provides him with information about the estimated delivery date.

6.3. Product dispatch
The trader prepares the ordered products and sends them to the customer's chosen address within the agreed period. The product return policy applies to shipped goods.

7. SALES AGREEMENT

The merchant issues a written invoice to the customer who buys the product from the online store, with itemized costs and an explanation of the right to withdraw from the purchase by returning the purchased product.

The sales contract between the Merchant and the buyer is concluded the moment the Merchant confirms the order. From this moment on, all prices and other conditions of purchase are fixed and apply to both the Merchant and the buyer.

8. RIGHT TO WITHDRAW THE PURCHASE, RETURN OF PRODUCTS

The buyer has the right to withdraw from the sales contract within 14 days from the day of taking over the ordered products to the trader at the contact email address info@alfies-corner.com or phone number 040 459 625, without having to give a reason for such a decision. The return of the purchased products to the Merchant within the deadline for withdrawal from the sales contract is considered a notice of withdrawal. The only cost incurred by the buyer due to withdrawal from the sales contract is the cost of returning the products to the Merchant.

Purchased products must be returned to the Merchant no later than 14 days from the date of submission of the notice of withdrawal from the sales contract. The purchased products must be returned to the Merchant undamaged, in the original packaging and in the same quantity, unless the products were destroyed, damaged, lost or their quantity decreased at the time of collection, without the fault of the buyer. It is considered that the notice of resignation or the product is sent on time, if the shipment is sent no later than 14 days after receiving the shipment.

For returned products, the Merchant will return the amount paid to the buyer no later than 14 days after receiving the notice of withdrawal. The refund of the paid amount is carried out by the Merchant in person or transaction account of the buyer.

In case of possible errors, the Merchant undertakes to eliminate the detected errors as soon as possible.

The Buyer can notify the Seller of the error via phone number 040 459 625 or via email to info@alfies-corner.com.

If unjustified costs have occurred due to an error, the Merchant undertakes to settle them no later than 14 days from the substantiated notification of the error.

The seller carefully packages all products in delivery packaging before shipping. All products are undamaged, inspected and in their original packaging before packaging.

The Company may withhold payment until the returned goods are received. For more detailed information on the product return procedure, call 040 459 625.

The return of products according to the above conditions only applies to products purchased through the company ALFIE'S CORNER, TANJA SIČANOVIĆ S.P., CIGLENCE 58A, 2241 SP. DUPLEK.

9. REMEDY OF ACTUAL OR IMPLIED DEFECTS

The Buyer must inform the Trader and provide a detailed description of the defects along with the complaint form to info@alfies-corner.com or phone number 040 459 625. The Buyer must allow the Trader to inspect the product with a real or hidden defect. If the defect is not in dispute, the Merchant replaces the product or refunds the purchase price to the customer within 14 days of receiving the complaint at the latest. If the Merchant does not agree with the actual error or there is a dispute about it, the Merchant must submit a written objection to the buyer within 14 days.

The merchant will ensure that all products subject to justified complaints are replaced or the purchase price for them will be refunded at IBAN.
The merchant reserves the right to reject the complaint in the event of:
that the returned goods are damaged by the buyer,
that the returned goods are not in their original packaging,
if the Merchant finds that the product is damaged or unusable as a result of improper behavior of the buyer.

10. DELIVERY

The merchant will deliver the ordered products to the customer within the agreed time. The Merchant's contractual partner for the delivery of shipments is Pošta Slovenije. The merchant reserves the right to choose another delivery service if it will carry out the order more efficiently.

In case of visible damage to the packaging or the goods, the buyer's complaint must be submitted to the Merchant or the delivery service upon receipt of the goods. The buyer is not obliged to accept such goods and must reject the shipment. In the event that the package is physically damaged, its contents are missing or shows signs of being opened, or the products in the package are damaged, but the buyer has collected such a package anyway, the buyer must initiate a complaint procedure with Pošta Slovenije or with the Merchant.

11. SECURITY

The merchant uses technological and organizational means to protect the transfer and storage of personal data and payments.

The user himself is also responsible for security, namely by ensuring his own security with appropriate software and anti-virus protection for his electronic devices.

12. CARE OF CHILDREN

The merchant in the online store does not accept orders from a customer whom he knows or suspects to be a child, without the express permission of his parents or guardians.

Without the express permission of parents or guardians, the merchant will not accept any personal data concerning children, nor will it release data received from children to third parties, except parents or guardians.

13. PRIVACY POLICY

The privacy policy is available on the subpage of our website.

14. LIABILITY

Photos of the products for sale in the online store are purely symbolic. Photos do not guarantee product features.

15. COMPLAINTS, DISPUTES AND APPLICATION OF LAW

The trader complies with the applicable regulations in the field of consumer protection. The merchant has a complaint handling system in place and has a designated person with whom the customer can contact by phone or e-mail in case of problems. In case of problems, the buyer can contact tel. no.: 040 459 625. The buyer can submit a complaint via e-mail to the address info@alfies-corner.com. The appeal process is confidential.

Within five working days, the merchant will confirm receipt of the complaint and notify the buyer of the estimated time of consideration. The trader will do his best to resolve any disputes amicably. In the event that an amicable solution to the dispute is not reached, the local real court in Ljubljana is responsible for resolving disputes between the Merchant and the buyer.
The trader and the buyer, as participants in electronic business, mutually recognize the validity of electronic messages in court.

Slovenian substantive and procedural law applies to the General Terms and Conditions and disputes between the Merchant and the buyer.

The provisions of the Code of Obligations, the Act on Electronic Business on the Market, the Act on the Protection of Personal Data and the Act on Consumer Protection apply to all relationships and rights and obligations that are not regulated by these General Terms and Conditions.

15.1 Out-of-court settlement of consumer disputes
In accordance with legal norms, the company ALFIE'S CORNER, TANJA SIČANOVIĆ S.P., CIGLENCE 58A, 2241 SP. DUPLEK does not recognize any out-of-court settlement of consumer disputes as competent for the resolution of a consumer dispute that the consumer could initiate in accordance with the Act on Out-of-Court Settlement of Consumer Disputes (hereinafter: ZlsRPS).

In the event that the buyer is not satisfied with the resolution of the complaint, in accordance with the ZlsRPS, he can file an initiative to start the procedure for the out-of-court resolution of a specific consumer dispute through the European platform for the online resolution of consumer disputes (SRPS).

The buyer can also decide to file a lawsuit with the competent court of his permanent residence.

16. CHANGES TO THE GENERAL TERMS AND CONDITIONS OF BUSINESS

In the event of changes to the regulations governing the operation of the online store, data protection and other areas related to the operation of the Merchant's online store, and in the event of changes to its own business policy, the Merchant may amend and/or supplement these General Terms and Conditions of Business. These general business conditions are stored on the Merchant's website.

Each time changes and/or additions to the General Terms and Conditions of Business come into effect and are applied after the expiration of eight days from the publication of the changes and/or additions. If changes and/or additions to the General Terms and Conditions are necessary due to compliance with regulations, these changes and/or additions may exceptionally come into force and be applied in a shorter time.

The buyer, who does not agree with the changes and/or additions to these General Terms and Conditions, must inform the Merchant in writing or request by e-mail that the controller of personal data permanently or temporarily stops using his personal data for the purpose of direct marketing. Otherwise, it is considered that the buyer accepts the changes and/or additions to the General Terms and Conditions.
